By accessing or using Cephie Studios services, including our website, Discord bot, API, and any related services (collectively, 'Services'), you agree to be bound by these Terms of Use and our Privacy Policy. You must be at least 13 years old to use our services. If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
Cephie Studios provides virtual airline management tools and services through various platforms. Our Services include but are not limited to: Discord bot functionality, flight tracking, statistics generation, API access, web dashboard features, image hosting, air traffic control tools, and chart services. We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without prior notice.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must have appropriate permissions to use our Services. You agree to provide accurate and complete information when using our Services and to update such information to keep it accurate and current. You are responsible for all content submitted through our Services.
You agree not to: (a) use the Services for any unlawful purpose; (b) attempt to access data you don't have permission to view; (c) interfere with or disrupt the Services; (d) attempt to reverse engineer any portion of the Services; (e) use automated means to access the Services without our permission; (f) collect or store personal data about other users without their express permission; (g) engage in harassment, abuse, or inappropriate behavior; (h) create multiple accounts to circumvent restrictions; (i) share your account credentials with unauthorized parties.
Cephie Studios reserves the right to access, monitor, and review all data transmitted through or stored on our Services. This includes but is not limited to: user communications, flight logs, server configurations, uploaded content, API usage patterns, and user behavior analytics. We may use this data for service improvement, security monitoring, compliance verification, and enforcement of these Terms. By using our Services, you consent to this data access and monitoring.
Cephie Studios maintains absolute discretion in enforcing these Terms and moderating our Services. We may take any action we deem necessary, including but not limited to: temporary or permanent suspension of accounts, removal of content, termination of API access, exclusion from partner programs, and sharing of violation information with third parties. We are not obligated to provide warnings before taking enforcement actions. Appeals may be considered but are not guaranteed to be reviewed or accepted.
Cephie Studios reserves the right to remove our Services from any Discord server or community at our sole discretion. This includes but is not limited to servers that: violate these Terms, engage in behavior detrimental to the Cephie Studios community, fail to comply with our moderation requests, or are deemed unsuitable for our Services. Server owners and administrators are responsible for all user activity within their servers when using Cephie Studios Services.
All code, design, concepts, and functionalities of Cephie Studios, including bot commands, APIs, and project ideas, are the intellectual property of Cephie Studios and are protected by international copyright and intellectual property laws. Any form of copying, reverse-engineering, reproduction, or usage without express written permission is strictly prohibited and may result in legal action.
Your use of our Services is also governed by our Privacy Policy. By using our Services, you consent to our collection, use, and sharing of information as detailed therein. We implement reasonable security measures to protect your data, but we cannot guarantee absolute security. You acknowledge that we may retain and use your data even after account termination for legal compliance and service improvement purposes.
The Services are provided 'as is' and 'as available' without warranties of any kind, either express or implied. Cephie Studios disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, Cephie Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Services. Our total liability for any claims related to the Services shall not exceed the amount you paid us, if any, for using the Services.
You agree to defend, indemnify, and hold harmless Cephie Studios, its affiliates, officers, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, or your breach of these Terms.
We may terminate or suspend your access to our Services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Services will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive. We reserve the right to permanently ban users across all our Services and share ban information with partner services.
Our Services may include links to third-party websites or services that are not owned or controlled by Cephie Studios. We are not responsible for the content, privacy policies, or practices of any third-party services. Accessing such services is at your own risk.
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles. Any dispute arising from or relating to the use of Cephie Studios shall be resolved through binding arbitration in accordance with the rules of the German Arbitration Institute (DIS), unless otherwise required by mandatory law.
We reserve the right to modify these Terms at any time. We will notify users of significant changes through our Discord server, website, or email. Your continued use of the Services after such modifications constitutes your acceptance of the modified Terms.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and Cephie Studios regarding the use of the Services and supersede all prior agreements and understandings.
The following terms apply specifically to the Cephie Studios Discord Bot in addition to all previous terms:
The Cephie Studios Bot facilitates flight log submission and management for virtual airlines. Users are responsible for the accuracy of all flight data submitted through the bot. Flight logs must represent actual simulated flights and comply with realistic aviation procedures.
The creation of intentionally false or non-compliant flight logs, as well as the misuse of bot commands, may result in permanent exclusion from our Services and partnerships. Failure to report such actions is treated equally and may lead to a global ban from Cephie Studios and its partner services.
If a user or server owner refuses to delete an invalid flight log, they may be subject to exclusion from our Services. This includes removal of bot access for the respective server. If a server owner denies such a request and no involved party reports the issue, all participants may be held accountable.
Manipulation of leaderboards or any statistics by submitting false or non-compliant flight logs, especially by server owners or staff members,can result in the full removal of Cephie Studios Services from that server and a global exclusion of those involved.
Discord servers using the Cephie Studios Bot must maintain appropriate moderation and comply with our community standards. Server owners are responsible for educating their members about proper bot usage and reporting violations to Cephie Studios staff.
The Cephie Studios Bot requires specific Discord permissions to function properly. Users and server administrators must not attempt to restrict these permissions in ways that compromise bot functionality. We reserve the right to discontinue service to servers that do not maintain proper bot permissions.
The following terms apply specifically to the Cephie Studios API in addition to all previous terms. Violation of any API terms will result in immediate and permanent suspension of API access:
Access to the Cephie Studios API requires a valid API key. You must never share your API key with unauthorized parties. API keys are tied to specific users and/or applications, and any misuse will result in permanent revocation of access and possible legal action.
All API endpoints are strictly rate limited. Exceeding these limits will result in immediate suspension of your API key. The current rate limits are: 60 requests per minute per API key. We do not tolerate attempts to circumvent these limits.
The Cephie Studios API provides access to different types of data depending on your authorization level: (1) Server-specific data: Flight logs and guild data for servers you have authorized access to; (2) Cross-server data: Certain approved projects and partnerships may have access to flight data and guild data from all servers using Cephie Studios services; (3) By using Cephie Studios services on your server, you acknowledge that approved third-party projects may access your server's flight logs and configuration data through the API.
Data obtained through the Cephie Studios API may only be used for the intended purpose of virtual airline management and approved integrations. Any scraping, unauthorized storage, or redistribution of API data will lead to permanent banning from all Cephie Studios services.
Some approved third-party projects and services may have elevated API access that includes access to flight data and guild configuration data from all servers. By using Cephie Studios services, you consent to this data sharing with approved projects for the purpose of enhancing the virtual aviation community.
Cephie Studios maintains a zero tolerance policy for API abuse. There are no warnings - violations will result in immediate, permanent termination of access to all Cephie Studios services, and we will pursue all available legal remedies against offenders.
